ICBC Traumatic Brain Injury Case
The Plaintiff was a young man hit by a car, suffering significant injuries, including a traumatic brain injury, and had little memory of the accident. ICBC argued that the fault for the accident lay with the Plaintiff. Shortly before the trial was to proceed, the law firm handling the claim transferred it to Simpson Thomas, as they were concerned that the claim could be dismissed outright. The trial proceeded on the issue of fault. At the conclusion of the trial, the court found the driver to be 100% responsible for the collision, and exonerated the Plaintiff of any responsibility for the accident.
